Proposal to repeal the legalization of the right to abortion in Argentina

A group of representatives of the ruling party presented a bill to repeal the legalization of the right to abortion in Argentina.

The bill, also known as IVE Law, Voluntary Interruption of Pregnancy, seeks to criminalize abortion.

Meanwhile, from the Casa Rosada, the presidential spokesman disassociated President Milei from this initiative.

“It is not part of the President’s agenda”, he assured.

The bill to repeal the legalization of the right to abortion in Argentina proposes penalties of 1 to 3 years in prison for women who cause their own abortion or consent that another person assists them to have an abortion.

Likewise, the proposal to repeal the legalization of the right to abortion in Argentina for anyone who causes an abortion on a woman without consent.

But likewise, 1 to 4 years if he/she acts with the woman’s consent; and “if the act is followed by the death of the woman”, the maximum penalty would be increased by 6 more years.

Proposal to repeal the legalization of the right to abortion in Argentina

The proposal to repeal the legalization of the right to abortion in Argentina was presented by deputies of La Libertad Avanza.

It includes that “the judge may order that the woman be exempted from the penalty in view of the motives that prompted her to commit the crime, her subsequent attitude, and the nature of the act”.

In addition, the bill clarifies that “abortion caused by a licensed physician with the consent of the pregnant woman and with the purpose of avoiding an imminent danger to the life of the mother is not punishable, provided that the danger cannot be avoided by other means”.

Among the grounds of the project to repeal the legalization of the right to abortion in Argentina, it alleges that the law on the Voluntary Interruption of Pregnancy is “unconstitutional”.

It even qualifies the expression “voluntary interruption of pregnancy” as a euphemism since it would be “plainly and undoubtedly an abortion” which, in other words, this bill defines as “the right to end the life of the unborn person“.

Derogating the Law on Voluntary Interruption of Pregnancy

The law of Voluntary Interruption of Pregnancy was approved in December 2020 in Argentina and legalized the performance of an abortion up to and including the 14th week of gestation.

The presentation of the bill that seeks to repeal it provoked varied reactions.

In the Casa Rosada, presidential spokesman Manuel Adorni declared that “it is not part of Milei’s agenda”.

In Congress, deputies such as Karina Banfi and Silvia Lospennato, both from the Pro party, expressed their rejection through the social network X after the position of the presidential spokesman.

In fact, the first of them tweeted: “People, it’s not going to happen. The end.”. When the law was debated, both voted in favor of the initiative.

Among the aspects of the Abortion Law in Argentina, it highlights that women and people with other gender identities with gestational capacity have the right to:

– Decide on the termination of pregnancy in accordance with the provisions of this law.

– Request and have access to care for the termination of pregnancy in the services of the health system in accordance with the provisions of this law.

– Request and receive postabortion care in the health system services. This even if the decision to abort was not legally enabled by law.

– Prevent unintended pregnancies through access to information, comprehensive sexual education and effective contraceptive methods.
