This case is part of a legal battle between the Department of Justice of Joe Biden’s administration and the government of the state of Texas, led by Republican Greg Abbott, who is accused of exceeding his powers by exercising control over the borders, which are under federal jurisdiction.
After being approved by the Texas Congress, Abbott enacted this law in December 2023, justifying it on the right of his state to defend itself against an “invasion”, when migrant crossings, mainly from Latin America, are reaching record numbers.
The rule allows Texas police and public security forces to arrest people in the state who cannot prove that they crossed the border legally.
They can be taken to the state justice system, where they could be sentenced to up to 20 years in prison or deported to Mexico, regardless of whether Mexico can accept them.

Currently, the thousands of migrants crossing into the United States turn themselves in to the Border Patrol, asking for asylum.
Many manage to wait for a response in freedom, in U.S. territory.
In a communiqué, the Mexican Foreign Ministry informed that it “welcomed” the U.S. court’s decision.
“I welcome the U.S. Supreme Court’s decision to extend the temporary stay of Texas’ SB4 law. Addressing the structural causes of migration is the answer, not the criminalization of migrants who contribute so much to their communities,” Foreign Minister Alícia Bárcena later wrote on X.
